TO: From: Tonya Caddle <Tonya.Caddle@alamance-nc.com> Date: Fri, Feb 18, 2022, 3:58 PM Subject: Ouarry Activity Good afternoon, Alamance County Planning Department has received emails expressing concerns regarding dump trucks entenng and exiting the Alamance Aggregates’ quarry, blasting activlty, and noise complaints. Alamance County’s authority to regulate business operations is limited by the U.S. Constitution, N.C. Constitution, and state law. Alamance County acts with the express and implled authonty granted to it by the General Assembly. The General Assembly authorizes local governments to regulate land use and as long as a business meets the requirements established by law, the County has no authority to restrict lawful activity. Alamance County Planning Department issued an Intent to Construct permit to Alamance Aggregates in January 2018. The Intent to Construct Permit is still in effect and was issued under the 2011 Heavy Industrial Use Ordinance provisions. Alamance County Planning Department has visited the site on multlple occasions, as recently as February 2, 2022, to ensure Alamance Aggregates was operating within authority granted by the Alamance County Planning Department issued permit. The activity observed by the Planning Department is consistent with scope of the work authorized by the Intent to Construct Permit. The next step in the process will be for Alamance Aggregates to apply for an operations permit. Prior to receiving an operations permit, Alamance Aggregates must submit a final as-built site plan. The North Carolina Department of Energy issued a mining permit to Alamance Aggregates in November 2020 and it was administratively modified in December of 2021. Regulating a mining permit issued by a State agency is outside of the authority of the County. Please let me know if you have any questions or concerns.
